Ohio - Storm Water Rule (NPDES requirements for industries, and large and medium MS4s) - OAC 3745-39-04

The rule was adopted on October 22, 2007 and becomes effective on November 1, 2007.

Background


As a delegated NPDES permitting authority, the Agency has adopted the remainder of the federal storm water rules (40 CFR 122.26) it is required to administer. This action adds rule -04 to Chapter 3745-39 of the Ohio Administrative Code. Previously, Chapter 3745-39 addressed discharges from small municipal separate storm sewer systems (MS4s). That program is commonly referred to as the U.S. EPA Phase II Storm Water Program. Rule -04 addresses discharges from large and medium MS4s and industries (including construction sites). Rule -04 contains the amended U.S. EPA Phase I rules (i.e., industrial conditional no exposure waiver and lowering construction program acreage disturbance threshold from 5 acres to 1 acre).
The new rule includes the recent change in federal law that narrowed the scope of the construction storm water program as it pertains to oil and gas operations. For more information on the federal law and associated rulemaking go to http://cfpub.epa.gov/npdes/stormwater/oilgas.cfm.
