North Dakota modifying the application process for obtaining coverage under the construction general permit

The North Dakota Department of Health will be modifying the application process for obtaining coverage under the construction general permit. The modifications only effects construction activity that is considered part of a larger common plan of development.

Below is a DRAFT guidance document which outlines the proposed modification. The Department is seeking comments regarding the modification from the regulated community and those involved with the permit. Please feel free to distribute the DRAFT document to additional individuals or organizations as you see fit. We ask that comments be submitted by September 14, 2007. All comments should be submitted to the contacts above. A FINAL guidance document will be developed by September 30, 2007.

The Department will begin the permitting process change after the guidance is finalized; the intent is to fully implement the change January 1, 2008. Owners and Operators who have obtained coverage under the current process will not be grandfathered in under the new process. We will send out Notice of Intents in December to those permittees who will need to reapply as a replacement for submitting the Annual Location Record.
