South Carolina -New - MS4 Transition Document (Updated 8/28/07)
There are new elements required before Construction/Land Disturbance Begins
Notice of Intent (NOI) for Stormwater Discharges from Large and Small Construction Activities, NPDES General Permit SCR100000

At this time several of the MS4s have elected to appeal the issuance of their permit coverage. Until a resolution can be reached in this matter, all projects in those MS4s will continue to be reviewed by the Department. Following are the MS4s that have appealed their permit coverage: Georgetown County, Berkeley County, Charleston County, City of Folly Beach, City of Isle of Palms, Town of Lincolnville, Town of Sullivan’s Island, City of North Charleston, City of Charleston, and Dorchester County. Also, the public comment period has been extended for the City of Aiken. The MS4’s review of projects located within the City of Aiken will begin at a later date.
Once the MS4 has issued their approval of the project, the MS4 will send the following information to the Department for us to issue coverage under the NPDES General Permit for Storm Water Discharges from Large and Small Construction Activities (CGP):
1. Copy of MS4 approval letter
2. Copy of Notice of Intent (NOI) or DHEC-approved equivalent application
3. $125 NPDES permit fee.
Once the above information has been received, the Department has 7 business days from the receipt of a complete NOI to send a letter authorizing coverage, denying coverage, requesting additional information or advising you that DHEC has decided to also review the SWPPP. Land-disturbing activity should not be initiated until the applicant has received approval from both the MS4 and DHEC. This process will be slightly different for projects located within the eight coastal counties under the jurisdiction of DHEC’s Office of Ocean and Coastal Resource Management (OCRM).
